Privacy Policy
Version 2026-10-28 · Effective October 28, 2026
Short version. We collect the information needed to run your business systems and apps, and use it to provide the Service to you. We do not sell your personal information, we do not use it for targeted advertising, and we do not use your content to train AI models without your separate consent. We share it only with the providers that help us run the Service, when you tell us to, or when the law requires it.
1. Who we are and what this covers
This Privacy Policy explains how the provider of the Driftpoint platform ("Driftpoint," "we," "us") handles personal information in our websites, portals, dashboards, AI assistants, phone and messaging features, and mobile apps, including the Howell Construction app (together, the "Service"). Driftpoint is provided by Howell Services LLC, a Florida limited liability company (Florida document number L26000520456). This policy is part of our Terms of Service.
Businesses that use the Service, such as Howell Construction, may publish their own privacy notices for their own customers. Those notices describe how that business handles its customers' information. This policy describes how we handle information in the Service.
2. Information we collect
Information you give us or put into the Service
- Account information: name, business name, email, phone number, password and PIN (stored only as protected hashes) and settings.
- Business content: clients, leads, jobs, quotes, invoices, payments you record, expenses, files, photos, notes, documents, evidence records and other content you add.
- Communications: emails, text messages and chats sent or received through the Service, along with their senders, recipients, times and attachments.
- Calls: call details such as numbers, times and durations; voicemails; and, where call recording is turned on, call recordings and transcripts.
- Workforce information: employee names, time-clock punches, hours and, if you turn it on, location at clock-in and clock-out.
Information collected automatically
- Device and app information: device type, operating system, app version, language, and update and error status.
- Usage and security logs: IP address, sign-in times, pages and features used, and actions taken, which we keep for security, audit and troubleshooting.
- Location: precise or approximate location only when you use a location feature (such as the time clock or job check-in) and allow location access on your device.
Information from others
- Information that your customers, leads, employees or other contacts send to you through the Service, for example by calling, texting or emailing your business line or filling out a form.
- Information from services you connect, such as email accounts, phone carriers, calendars or social media accounts, in line with your settings and their terms.
3. Our apps and device permissions
Our mobile apps, including the Howell Construction app, ask for device permissions only to make specific features work. You can deny or turn off any permission in your device settings. The related feature will then stop working.
| Permission | Used for |
|---|---|
| Internet and network state | Connecting to your portal and checking whether you are online. |
| Location (precise and approximate) | Time clock, job check-in and location features, only while you use them and only with your permission. |
| Camera | Taking photos for jobs, receipts and records, and video calls, only when you choose to. |
| Microphone and audio settings | Voice features and calls, only while you are using them. |
| Notifications, full-screen alerts and vibration | Alerting you to new calls, messages, leads and reminders. |
| Foreground service and start at boot | Keeping an active call or voice session running, and restoring alerts after your phone restarts. |
| Bluetooth connect | Using your Bluetooth headset or car audio during calls. |
| Install packages and storage | Installing verified updates to the app itself. |
The apps store your sign-in credentials encrypted on your device using the Android Keystore. The apps do not include advertising software or third-party analytics or tracking software. They do not read your contacts, call log, text messages or photo library unless a feature asks you to choose specific items to share.
4. How we use information
- To provide, operate, maintain and support the Service, and to carry out the actions you request or set up, such as sending messages, answering calls, sorting leads and producing reports.
- To secure the Service: authenticating users, keeping audit logs, and detecting, investigating and preventing fraud, abuse, spam and unauthorized access.
- To communicate with you about your account, security, updates, changes to our terms and support.
- To improve the Service, using aggregated or de-identified information where possible.
- To comply with law and legal process, to enforce our Terms, and to protect the rights, property and safety of you, us and others.
Our administrators can access account information only as needed to operate, secure, back up, support or fix the Service, to follow your instructions, to comply with law, or to enforce our Terms. Some records, such as certain personal logs, are encrypted so that only you can read them.
5. AI processing
AI features work by sending the relevant content, such as a message, call transcript or document, to an AI service provider to generate a response, summary, classification or draft. Some AI features run on an AI account you hold yourself. AI providers process this content under their own terms and privacy policies. We do not use your content to train AI models unless you give separate, express consent. AI output can be inaccurate. See Section 4 of our Terms.
6. How we share information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share information only:
- With service providers that process it for us under contracts or terms that limit their use of it: cloud hosting and backup, telephone and messaging carriers, email delivery, AI providers, mapping and software-update delivery.
- At your direction, for example when you send an email or text, share a document or link, connect another service, or ask us to give someone access.
- Within your account, with people you authorize, such as co-owners, employees or administrators, according to the access you set up.
- For legal reasons, when we believe in good faith that it is needed to comply with law, a subpoena, court order or other legal process; to enforce our Terms; or to protect the rights, property or safety of you, us or others.
- In a business transfer, such as to Howell Services LLC or as part of a merger, sale, financing or reorganization. The recipient must handle your information in line with this policy.
- With your consent, in any other case.
7. Your customers', employees' and contacts' information
When you use the Service to manage information about other people, such as your customers, leads, employees and the people you call, text or email, you decide what is collected and how it is used. We process that information for you. You are responsible for giving those people any required notice, for getting any required consent (including for call recording and text messages), and for responding to their privacy requests. We will reasonably help you do so. If someone contacts us about information a business holds about them, we may refer them to that business.
8. Text messaging
Mobile phone numbers and text-message opt-in information collected through the Service are not shared with or sold to third parties or affiliates for their marketing or promotional purposes. They are shared only with the carriers and providers needed to deliver messages. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help.
9. Cookies and tracking
We use cookies and similar storage that are strictly necessary to sign you in, keep your session secure and remember your settings. We do not use advertising cookies or third-party tracking pixels. Our services do not currently respond to browser "Do Not Track" signals, because we do not track you across other websites.
10. Retention
We keep information for as long as your account is active and as needed to provide the Service. After that, we keep it only as long as needed to comply with legal, tax, accounting and evidence-preservation duties, to resolve disputes, to keep security and audit records, and to enforce our agreements. Deleted information may remain in encrypted backups until the backups cycle out. You can ask us to delete information as described in Section 12.
11. Security
We use administrative, technical and physical safeguards designed to protect information. These include encryption in transit, encrypted backups, hashed passwords and PINs, access controls that separate each person's and business's data, and audit logging. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we learn of a security breach affecting your personal information, we will notify you as the law requires.
12. Your choices and rights
- Access, correction, export and deletion: you can view and update much of your information in the Service. You can also ask us to give you a copy, correct it, export it or delete it.
- Communications: you can opt out of non-essential emails. We may still send messages about security, your account and legal changes.
- Device permissions: you can turn location, camera, microphone and notifications off in your device settings.
- State privacy rights: depending on where you live, you may have additional rights under state law. These can include the right to know, access, correct, delete and port your information, and to opt out of its sale, of targeted advertising and of certain profiling. We do not sell personal information or engage in targeted advertising. We will not discriminate against you for exercising your rights.
To make a request, email us at the address in Section 16. We may need to verify your identity before acting. You may use an authorized agent where the law allows. If we deny your request, you may appeal by replying to our decision. Some requests are limited by law, for example where we must keep records or where the information belongs to a business account that someone else controls.
13. Children
The Service is not directed to children under 18, and we do not knowingly collect personal information from children under 13. If you believe a child has given us personal information, contact us and we will delete it as the law requires.
14. Where information is processed
We and our service providers process and store information in the United States. If you use the Service from outside the United States, your information will be transferred to and processed in the United States.
15. Changes
We may update this policy. We will post the new version here with a new version date. If a change is material, we will give you notice, for example in the app, by email or at sign-in, and we may ask you to review and accept it before you keep using the Service.
